The Supreme Court is scheduled to hear the petitions challenging the abolition of Article 370 on July 2023. The petitions for challenging the abrogation of Article 370 have been mainly filed by leaders of political parties and some critics individual. Omar Abdullah mentioned he is confident that the Supreme Court give a verdict in the favor of people of Jammu and Kashmir. The Vice President of JKNC mentioned, “The abrogation of Article 370 was a unilateral decision by the government and it was not done after having a consultation with the people of J&K”.
What is Article 370 and why it was abolished in India?
Article 370 falls under a constitutional provision that allows Jammu and Kashmir a specific status within the Indian Union. Article 370 gives various special autonomy powers to the state. Under the autonomous powers, it includes J&Ks own constitution, a separate flag, and control over its own citizenship laws. Following the abrogation of Article 370, the Indian Government mentioned, Article 370 is discriminatory, and blocked the development of J&K. Article 370 is a crucial security risk because it allows the creation of a separate “Kashmiri identity” which can be exploited by Pakistan.
